在沖米兵による性暴力・ヘーゼル事件の軍法会議開廷を前に
ヘーゼル事件を裁くための軍法会議が、来る2月23日から27日までの5日間で開かれることが決定した。
ヘーゼル事件とは、ちょうど一年前の2008年2月18日沖縄で、フィリピン人女性・ヘーゼル(仮)(当時22)が、在沖陸軍パトリオット・ミサイル部隊所属・特技伍長(当時25)によってレイプされた事件だ。レイプ行為によって、被害者は1週間の入院を要する怪我も負った。しかし事件は、米兵を強姦致傷容疑で書類送検する方針が一旦出されるも、嫌疑不十分の不起訴処分となり、日米地位協定に従い裁判権が米軍側へ移された。
私たちは事件発生から今日までの間に、ヘーゼルやフィリピンにいるヘーゼルの家族との交流、支援を続けてきた。日本では性暴力被害者に対して「そっとしておいてあげるべき」という風潮がとても強くあるが、支援者さえ関わるべきでないというのとは違う。私たちが被害者との直接の交流を求めるのは、被害者が支援者と出会うことで、笑顔を取り戻したり、尊厳の回復や正義を獲得するために闘い続ける勇気を得ることが出来るからである。
また、当事者でない私たち自身が、被害者や被害者家族の苦しみに深く共感することが出来る。11月頃にヘーゼルに会ったとき、彼女は私たちに笑顔を見せてくれていた。しかし、その時彼女からもらった手紙には「私の心の奥深くは孤独で、今も動揺していて、不安の中にある」という一文が綴られていた。彼女は今でも睡眠薬や精神安定剤の服用は欠かせない状態にあるのだという。性暴力とは、どれだけ被害者を苦しめるものであるのか、その理解がなければこうした事件を解決していくための答えは見えてこない。
2007年10月広島で起こった米兵による集団レイプ事件以降、日本の司法によって不起訴にされた事件に対し、米軍が軍法会議の開催やそれ自身を日本のマスコミに公開するようになった。このパフォーマンスによって、「規律高い、誠実な米軍」と「犯罪を裁かない日本の司法」の姿が印象付けられ、軍法会議に事件の解決を期待する声も多く上がった。しかし、私たち市民は決してこのパフォーマンスに騙されてはいけない。
1945年の敗戦以来、駐留する米軍基地周辺では米兵による性暴力犯罪が現在まで無数に繰り返され続けている。事件が起こるたびアメリカは「綱紀粛正」を口にしてきた。しかし、軍隊とはそもそも、人の痛みを感じる心を麻痺させ、人殺しをすることのできるよう日々兵士を訓練するところであって、そこで訓練を受けた兵士たちによって性暴力犯罪が起こされている。いくら「規律ある軍隊」をアピールしたところで、米兵による性暴力犯罪はなくならない。米軍が駐留した60年もの長い歴史と性暴力被害者たちがそれを教えてくれている。それが、軍法会議が開かれたところで変わりはしない。昨年公開された広島レイプ事件での軍法会議判決では、「同意なしで性行為をした罪」や「不正性的行為」という罪でもって強かん罪を認めず、司法取引などによって本来、米本国では25年から終身刑を科すような凶悪犯罪である強かん犯罪を、“たった1年程度の懲役と除隊”という軽い処罰を4人の加害米兵に与えたに過ぎなかった。軍法会議は軍隊の規律統制のためでしかなく、ここでは被害者の尊厳を回復させるための公正な裁判が行われることも、性犯罪者を生み出す軍隊そのものを問うことも決してないのだ。
犯罪を裁かなかった日本の司法は、本来、時の権力者による政治にコントロールされない独立性を持ち、犯罪に対しては社会的制裁がきちんと与えられる場でなくてはならなかったはずであるのに、それを裏切った。日本の司法が米兵犯罪を裁かない大きな背景には、日米間の軍事同盟とその下での日米地位協定がある。「虎の威を借る狐」のように米軍の強大な軍事力を背景に経済力を拡大させてきた日本『国家』にとって、“日米軍事同盟を維持すること”が、犯罪被害者や犯罪に怯えて暮らさなければならない基地周辺住民の人権回復、擁護よりも優先事項なのである。このことは「米兵の「公務外」の犯罪で「特別な重要性」がない限り日本側が一次裁判権を放棄する」という日米間の密約の存在からも明らかになっている。
結局のところ、“日米軍事同盟の維持”が日米両政府にとって最も重要なことなのである。しかし、私たち市民とその利害関係は決して一致しない。“日米軍事同盟の維持”は米兵による性暴力犯罪を温存し、市民を苦しめ続けている。女性たちに対する侵略戦争は今も続いている。
性暴力被害は、加害者より被害者にバッシングが集中することがとても多い。しかし、本当は無理やり性行為を強制する加害者が悪いのであって、被害者は被害者である。起こり続ける米兵による性暴力犯罪に対して、私たち市民一人一人が性暴力被害者を被害者と認識し、彼女たちの苦しみを理解し、二度と同じ過ちが繰り返されないようきちんと日本の司法に裁かせなければならない。
そして、米軍基地をなくしていくことが、私たち市民にとって本当の意味での平和に繋がるのである。

Statement on the Military Court-Martial of the Hazel Case
Stop Sexual Violence of US Military!
The US military will open the military court-martial on a rape case against one woman from February 23 to 27. The rape case happened on February 18, 2008 in Okinawa. A US military serviceman raped a Filipino woman, known as Hazel who was 22 years old at the time. She was injured and hospitalized for a week by the incident. Although the media reported that the police would prosecute the military man, the case was dropped later because of insufficient evidence and the custody of the man was transferred to the US military in accordance with the SOFA between US and Japan.
We have had communication and relationship with Hazel and her family in the Philippines, and have held the supporting campaign. Although the social climate in which people think that victims of rape should be left alone strongly exists in Japan, we believe that victims will be empowered by supporters and can be brave enough to stand up for her dignity and justice through exchanges with other women. When we met Hazel in November 2008, she was smiling, but her letter was saying, “I am still alone in my deep heart. I am unsettled and confused.” She is still taking sleeping pills and tranquilizers. If we want to achieve justice, we have to know how sexual violence suffers the victim.
Since the gang-rape by US military men in Hiroshima in October 2007, the US military started to invite media reporters to the military court-martial. It was their tactics to make media coverage to propagate that the US military is sincere enough to prosecute the perpetrators, though Japanese prosecutor’s office drops the cases. We have to criticize their evil tactics.
We have witnessed numerous cases of sexual violence by US military especially around US bases in Japan since 1945. The US administration always says about “enforcement of official discipline” at the rape cases. However, the military is an institution in which people will be made into killing machines through daily trainings to loose their consciousness to feel hurts of others. The rape cases are created by this function of the military. Their “tighter discipline” can not stop the rape. The history of the US military in Japan tells the fact. Even the current military court-martial will not eliminate the sexual violence. The military court-martial made a final decision on Hiroshima gang-rape case last year. It did not recognize the case as “rape”, but convicted to be "wrongful sexual misconduct and indecent acts". The perpetrators were sentenced only one year in jail and dismissal by plea deal, though gang-rape is supposed to be punished by at least 25 years in jail in the US. The US military court-martial is only for discipline and control of the soldiers and not for fair judges and justice for victims. Of course, it never criticizes the nature of military itself.
The Japan’s judicial authorities were supposed to be independent from the political rulers, and they were expected to judge the criminals. However, they have betrayed us. The Japan’s judicial authorities and political rulers prioritize the US-Japan military alliance and SOFA over the human rights of the people in Japan. The Japanese government has kept the secret treaty with the US that stipulates abandonment of jurisdiction over the crimes of US soldiers off duty in Japan.
The US-Japan military treaty is the most important for the Japanese and US government. The interest of the people is not served by them. The military treaty will keep sexual violence happen, and will continue to suffer us. Women are still under the war of aggression.
The perpetrators are to be blamed, though victims tend to be wrongly criticized in the cases of sexual violence. We need to uphold the right of rape victims now. We need to know their sufferings and make the Japanese judicial authorities judge the criminals. We need to eliminate all the US bases for the sustainable peace of the people.
